Transmission Release of Easement Instructions

This section contains the instructions for requesting the release of a transmission easement and the specifications for preparing the accompanying survey(s). Transmission easement releases are generally limited to relocation projects where a replacement easement is granted or, in the case of a blanket easement, to bring greater clarity in defining the transmission right of way.  An easement may be fully or partially released based on the location of the tract of land in relation to the transmission facilities.

Application Process for the Release of a Transmission Easement

To initiate the release of a transmission easement, mail your completed application, a check payable to Duke Energy in the amount of $500.00 and the items requested in What to Submit with Your Application (below) to the following address:

If you are requesting a release for more than one easement, a separate application and fee is required for each request.

A Duke Energy Land Representative will be assigned to your request to ensure that a complete package has been submitted. If the package has missing information, the Land Representative will contact you and may hold your application until the necessary items are received. Your application is then routed through various Departments for approval.  An engineer will review the application with other departments to determine whether future Duke Energy projects may conflict with your request. On occasion, an inspection by a Duke Energy representative may be necessary. It will take 8-12 weeks to complete the investigation and for an engineer to approve or disapprove your request.

What to Submit with Your Application

  1. Copy of your deed.
  2. Copy of the grant of easement affecting the subject property.
  3. Location map. Draw your location map on 8 1/2 x 11 inch paper and make it detailed enough that someone unfamiliar with the area can find the project site. At minimum your map should include a north arrow, major roads, prominent landmarks, a reference to the nearest city or town, and detailed directions from the nearest major intersection to the project site.
  4. Surveys as described in the Survey Specifications below.   

Survey Specifications

A minimum of two surveys will be required to process your request. Your initial application should include a certified Boundary Survey of the parent tract including all of the information listed below along with a certified sketch and description of the easement area to be retained. 

If the easement does not specify a right-of-way width, then a Duke Energy Engineer will determine the width of the easement during the review period.  Please contact the Land Representative for instructions if you are unsure of what to submit initially.

 

  • All Duke Energy facilities (poles, guy wires, access roads, etc). Show the type of structure(s), for example, wood or concrete pole(s), lattice tower, H-frame, etc.
  • Show the centerline of the transmission structures.
  • Label each Duke Energy structure with its structure number. All Duke Energy transmission structure numbers are located on the pole or on one the legs of the towers. The numbers are usually located chest high and have a letter and number designation. For example: ANL-67. (If no number is visible, please get the number from the nearest structure.)
  • Existing utilities and improvements. Show the distance from existing or proposed improvements to the easement area and structures.
  • Show the Section, Township, Range and County.
  • Show a North arrow.
  • Please note:  you may also be asked to provide an electronic copy of the Boundary Survey in an Adobe Acrobat (.pdf) format along with its legal description in MS Word format. 

All sketch and descriptions should be prepared on 8½ x 11 inch or 8½ x 14 inch paper (suitable for recording) and include a North arrow, Section, Township, Range, County and an EXHIBIT “A” notation.

If Your Request is Approved

If your request is approved, the Land Representative will contact you with any additional requests necessary to complete the process.  In some instances, you may be asked to execute a Supplemental Easement or Bi-Lateral Partial Release of Easement for any future need of the remaining easement area.

The Land Representative will then prepare the appropriate Release of Easement document and record it in the public records of the county your property is located in. A copy of the fully executed and recorded document will be mailed to you when received back from the county.

If Your Request is Denied

A Duke Energy Land Representative will notify you in writing of the reason your request was denied.
